## Narrative

As the FAA filed it, in capitals; the FAA replaces private details with ^PRIVACY DATA OMITTED^.

NARRATIVE: IT IS ALLEGED THAT PASSENGER CHARLES NOVAK SMOKED IN AIRCRAFT LAVATORY IN VIOLATION OF FAR'S. LEGAL ENFORCEMENT PACKAGE FORWARDED TO AGL-7. ON SATURDAY, MARCH 14, 1998, AT APPROX. 1900 HRS. I HAD AN ASSIGNMENT TO ASSIST THE CREW OF RYAN INT. WITH A PASSENGER SMOKING ON THE AIRCRAFT ON A FLIGHT FROM ARUBA. THE FLIGHT ARRIVED AT APPROX. 1900 HRS. I MET THE SAME FLIGHT CREW WHO IDENTIFIED THE PASSENGER. AT THIS TIME I SPOKE WITH THE FLIGHT CAPTAIN WHO INFORMED ME THAT AS HE (CAPTAIN) WAS STANDING NEAR THE FORWARD LAVATORY HE SMELLED SMOKE WHEN THE DOOR OPENED. A PASSENGER EXITED THE LAVATORY AND THE SAME CAPTAIN ASKED THE MALE WHO JUST EXITED THE SAME LAV. IF HE WAS SMOKING? AND THIS SAME MALE RESPONDED TO THE CAPTAIN THAT HE WAS SMOKING AND HE DISPOSED OF THE CIGARETTE IN THE TOILET. THE PASSENGER WAS ADVISED TO RETURN TO HIS SEAT. NO OTHER INCIDENT OCCURRED WITH THE PASSENGER. I SPOKE WITH THE SAME PASSENGER WHO ADMITTED THAT HE WAS SMOKING IN THE LAVATORY AND THAT HE FLUSHED THE CIGARETTE IN THE TOILET. THIS SAME PASSENGER WAS ADVISED OF HIS VIOLATION AND AFTER OBTAINING POSITIVE ID AND TICKET INFO. HE WAS RELEASED. (WITNESS INFO. CAPTAIN SCOTT BUSHONG, RYAN INT.)

From the FAA Accident/Incident Data System. Reports are matched to registry aircraft by N-number and event date, checked against the reported make and model; the registry's history has gaps, so older matches can be wrong. Compare the reported make and model. For accidents, the NTSB's own investigation is the fuller record.
