## Narrative

As the FAA filed it, in capitals; the FAA replaces private details with ^PRIVACY DATA OMITTED^.

(-23) PRIOR TO THE INCIDENT THE CREW HAD BEEN ASKED TO EXPEDITE THEIR DESCENT TO FL400 BY A PREVIOUS CONTROLLER, AND BECAUSE THEY WERE EMPTY THEY COULD EASILY COMPLY. THEY SAID THEY MAY HAVE REPORTED LEVEL FL400 A BIT PREMATURELY, AND DUE TO THE HIGHER THAN NORMAL RATE OF DESCENT, THE AUTOPILOT DID NOT BEGIN TO CAPTURE THE ALTITUDE SOON ENOUGH. SWA3167 OBSERVED AN RA MOST LIKELY DUE TO EJA934'S HIGH RATE OF DESCENT, RATHER THAN EJA'S MOMENTARY DESCENT BELOW FL400. (CREW STATED THEY WENT NO LOWER THAN FL398 BY THEIR INSTRUMENTS). THE INCIDENT WAS REPORTED TO THE OPERATOR'S AVIATION SAFETY ACTION PROGRAM (ASAP). THE ASAP EVENT NUMBER IS 1396.

From the FAA Accident/Incident Data System. Reports are matched to registry aircraft by N-number and event date, checked against the reported make and model; the registry's history has gaps, so older matches can be wrong. Compare the reported make and model. For accidents, the NTSB's own investigation is the fuller record.
