(-23) On initial test flight of ultralight the engine power was found inadequate to continue flight out of ground effect. Ultralight settled into ground/vegetation causing extensive damage to right lower wing and tail spar. Minor injuries to pilot. Post crash inspection of engine by pilot revealed no discernable mechanical problems. Based upon written statements of owner regarding power plant instillation and initial weighing of the vehicle to determine empty weight and CG as well as kit manufacturer data, it is determined that the vehicle qualified as an ultralight under FAR part 103. Investigation closed with no further action.
