Note that paragraph (a) contains the certification basis of the unmodified restricted category PA-36 airplanes (as specified on Type Certification Data Sheet (TCDS A10SO) for parts not changed or not affected by the change while paragraph (b) lists the current version (latest amendment) of the Federal Aviation Regulation (FAR) 23 sections used for the parts changed or affected by the change.
(a) FAR 21 dated February 1, 1965, including Amendment 21-1 through 21-24 dated February 9, 1969, and FAR 23 dated August 1, 1967, including Amendments 23-1 through 23-6 dated August 1, 1967, with exceptions to FAR 23 per FAR 21.25 (a) (1). Note 4 of the TCDS lists the following exceptions to FAR 23 which were granted based on the Restricted Category operating limitations:
FAR 23.25 (a); 23.77 (b); 23.335; 23.337; 23.1505; 23.1507; 23.1545; and 23.1583 (a).
(b) Current FAR 23 regulations which are applicable:
Airframe
23.303, 23.337 (amdt. 34), 23.341 (amdt. 42), 23.361 (amdt. 26), 23.363, 23.371(b) (amdt.26),
23.613 (amdt.23), 23.615 (amdt.71), 23.625 (amdt.7) and 23.629(e) (amdt.31).
Note: FAR 23.629 (e), Whirl Mode Instability, is required by current regulation for all turbopropeller installations.
Powerplant FAR 23.903(b) and (e) (amdt.40), 23.937 (amdt.7), 23.939(a) and (c) (amdt.42), 23.991(a) (2) (amdt.26), 23.1019(a) (amdt.29), 23.1045 (amdt.7), 23.1091(c) (amdt.7), 23.1111 (amdt. 17), 23.1141
(e) (amdt. 18), 23.1155 (amdt.7), 23.1521 (amdt.21), 23.1557(c) (amdt.23).
NOTE (1): FAR 23.1093(b) "Induction System Icing Protection" is not contained in the certification basis, having been deemed by the FAA in the past as "an inappropriate requirement for restricted category turbopropeller aircraft used for agricultural purposesi. Instead, as was done with the Grumman American G-164D, an operational limitation is imposed prohibiting flight at ambient temperatures below 40 degrees Fahrenheit in a visible moisture. A corresponding cockpit placard is NOTE (2): Consistent with the approach taken in the certification of previous turbopropeller-powered agricultural airplanes in complying with FAR 23.1141(e), an instrument-panel control for the engine fuel control unit (to backup the throttle) is not required.

23.1337 (amdt.18).
Flight Test FAR 23.1581 (amdt.34), 23.337 (amdt.34), 23.341 (amdt.42), 23.625 (amdt.7), 23.1303(d) and (e) (1) (amdt. 17), 23.1309(b) and (d) (amdt.41), 23.1311 (amdt.41), 23.1321(c) and (e) (amdt.41), and 23.1322 (amdt. 17), 23.937 (amdt.7); 23.1521 (amdt.21) and 23.1557(c) (amdt.23).
The following paragraphs (a. and b.) explain why certain environmental regulations are not included in the certification basis of this project. The rationale is included here for documentation purposes only:
a. The Noise Standards of FAR 36 do not apply because agricultural aircraft are excluded (Ref. FAR
36.1 (a)(2)). The placard requirement for "non-complying agricultural airplanes" is not applicable because this regulation is directed at airplanes receiving a standard airworthiness certificate. (Ref. FAR
36.1583 (a) (2) (i)).
b. The Fuel Venting and Exhaust Emission Requirements of FAR 34 do not apply because this regulation is only applicable to airplanes with a standard airworthiness certificate. (Ref. FAR 34.3 (C)).
Note that this regulation was previously contained in Special FAR 27-5, Section 1.(b).
